Protecting your private information is a priority for ColliderCraft Games Company Inc. (“Company”). By using the Company’s website or services, and/or accessing and/or participating in Moshpit, you (“Customer”) consents to the data practices described in this statement.

Collection of Customer’s Personal Information

In order to better provide Customer with products and services offered, Company may collect personally identifiable information, such as Customer’s:

Information automatically collected when Customer uses Company’s website or service, and/or accesses and/or participates in Moshpit, including information to facilitate Customer’s experience and help Company understand Company’s visitors, like Customer’s device information, information about the network Customers are using to access Company’s services or websites (such as preferred language or online sites or services visited before Customer visits a Company’s service or website), and content (including ads) that Customer sees or clicks on.

Information about the device, browser, or app Customer is using to access a Company’s website or service, and/or to access and/or to participate in Moshpit, such as operating system, browser information, Internet Protocol (IP) address, Universal Device Identifiers (UDID), and similar information.

-Interest or demographic information. Information about a Customer’s favorite games, colors, Company characters, and similar preferences; or information about Customer, such as gender, age, education, profession, occupation, or other information.

-Location information. Information that allows Customer to be precisely located, such as through GPS coordinates on a mobile app.

-Login information. Information to identify and validate a Customer to allow access to a Company’s website or service, and/or to access and/or to participate in Moshpit.

-Order information. Information provided to access to a Company’s website or service, and/or to access and/or to participate in Moshpit, or to purchase Company’s services, including details necessary to fulfill the transaction, such as products ordered, payment information, and personal contact information.

-Payment information. Virtual wallets, credit card numbers, or other financial institution-issued information provided to complete a transaction, including (as applicable) personal contact information.

-Personal information. Information that identifies (whether directly or indirectly) a particular individual, such as the individual’s name, address, email address, device identifier, telephone number, or assigned identifier. When anonymous information is directly or indirectly associated with personal information, this anonymous information also is treated as personal information.

-Personal contact information. Information that allows Company to contact Customer directly, such as Customer full name, email address, home address, telephone number, mobile number, etc.

-Survey information. Answers to surveys or questionnaires voluntarily provided.

-Social sign-on information. Login information and other information (such as friend lists) from a social network that a Customer chooses to share with Company to access a Company's service or website, and/or to access and/or to participate in Moshpit.

-Third-party-provided information. Data shared with Company through a third party.

-User-generated content. Information Customer posts or uploads, like reviews, comments, videos or pictures, or social media interactions.

Please keep in mind that if Customer directly discloses personally identifiable information or personally sensitive data through Company's public message boards, this information may be collected and used by others.

Except as otherwise provided in this Privacy Policy, Company does not collect any personal information about Customer unless Customer voluntarily provides it to Company. However, Customer may be required to provide certain personal information to Company when Customer elects to use certain products or services. These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by Company or one of Company’s partners; (c) signing up for special offers from selected third parties; (d) sending Company an email message; (e) submitting Customer’s payment information when ordering and purchasing products and services. To wit, Company will use Customer’s information for, but not limited to, communicating with Customer in relation to services and/or products Customer has requested from Company. Company also may gather additional personal or non-personal information in the future.

Use of Customer’s Personal Information

Company collects and uses Customer’s personal information to operate and deliver the services and/or products Customer has requested. Company may also use Customer’s personally identifiable information to inform Customer of other products or services available from Company and its affiliates.

Sharing Information with Third Parties

Company does not sell, rent or lease its Customer lists to third parties. Company may, from time to time, contact Customer on behalf of external business partners about a particular offering that may be of interest to Customer. In those cases, Customer’s unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. Company may share data with trusted partners to help perform statistical analysis, send Customer email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using Customer’s personal information except to provide these services to Company, and they are required to maintain the confidentiality of your information.

Company may disclose Customer’s personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Company or its site; (b) protect and defend the rights or property of Company; and/or (c) act under exigent circumstances to protect the personal safety of Customers or users of Company, or the public.

Tracking Customer Behavior

Company may keep track of the websites and pages Customers visit within Company, in order to determine what Company services and/or products are the most popular. This data is used to deliver customized content and advertising within Company to customers whose behavior indicates that they are interested in a particular subject area.

Automatically Collected Information

Information about Customer’s computer hardware and software may be automatically collected by Company. This information can include: Customer IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Company’s website.

Use of Cookies

The Company website may use “cookies“ to help Customer personalize Customer online experience. A cookie is a text file that is placed on Customer’s hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to Customer’s computer. Cookies are uniquely assigned to Customer, and can only be read by a web server in the domain that issued the cookie to Customer. One of the primary purposes of cookies is to provide a convenience feature to save Customer time. The purpose of a cookie is to tell the Web server that Customer has returned to a specific page. For example, if you personalize Company pages, or register with Company site or services, a cookie helps Company to recall your specific information on subsequent visits. This simplifies the process of recording Customer’s personal information, such as billing addresses, shipping addresses, and so on. When Customer returns to the same Company website, the information Customer previously provided can be retrieved, so Customer can easily use the Company features that Customer customized. You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but Customer can usually modify Customer’s browser setting to decline cookies if Customer prefers. If Customer chooses to decline cookies, Customer may not be able to fully experience the interactive features of the Company services or websites Customer visits.

Company’s website may contain links to other sites. Please be aware that Company is not responsible for the content or privacy practices of such other sites. Company encourages its Customers and users to be aware when they leave Company’s site and to read the privacy statements of any other site that collects personally identifiable information.

Security of Customer Personal Information

Company secures Customer’s personal information from unauthorized access, use, or disclosure. Company uses the following methods for this purpose:

-SSL Protocol

When personal information (such as payment information) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.

Company strives to take appropriate security measures to protect against unauthorized access to or alteration of Customer’s personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while Company strives to protect Customer’s personal information, Customer acknowledges that: (a) there are security and privacy limitations inherent to the Internet which are beyond Company’s control; and (b) security, integrity, and privacy of any and all information and data exchanged between Customer and Company through this Company’s site cannot be guaranteed.

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from Customer, Company will:

-Delete Customer’s personal information from Company’s records; and

-Direct any services providers to delete Customer’s information from their records.

Please note that Company may not be able to comply with requests to delete Customer’s personal information if it is necessary to:

Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by Customer, or reasonably anticipated within the context of Company ongoing business relationship with Customer, or otherwise perform a contract between Customer and Company;

-Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

-Debug to identify and repair errors that impair existing intended functionality;

-Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

-Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when Company deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided Company has obtained Customer’s informed consent;

-Enable solely internal uses that are reasonably aligned with Customer’s expectations based on Customer’s relationship with Company;

-Comply with an existing legal obligation; or

-Otherwise use Customer’s personal information, internally, in a lawful manner that is compatible with the context in which Customer provided the information.

Children Under Thirteen

Company does not knowingly collect personally identifiable information from children under the age of thirteen. If Customer is under the age of eighteen, Customer should ask her or his parent or guardian for permission to use Company’s website, and/or accesses and/or participates in Moshpit.

Disconnecting your Company Account from Third Party Websites

Customer might be able to connect Customer’s account to third party accounts. BY CONNECTING CUSTOMER ACCOUNT TO CUSTOMER’S THIRD PARTY ACCOUNT, CUSTOMER ACKNOWLEDGES AND AGREES THAT CUSTOMER IS CONSENTING TO THE CONTINUOUS RELEASE OF INFORMATION ABOUT CUSTOMER TO OTHERS (IN ACCORDANCE WITH CUSTOMER’S PRIVACY SETTINGS ON THOSE THIRD PARTY SITES). IF CUSTOMER DOES NOT WANT INFORMATION ABOUT CUSTOMER, INCLUDING PERSONALLY IDENTIFYING INFORMATION, TO BE SHARED IN THIS MANNER, DO NOT USE THIS FEATURE. Customer may disconnect Customer’s account from a third party account at any time. Customer may disconnect any third party service by visiting their account page and disconnecting the service from their user preferences.

Communications

From time to time, Company may contact Customer through official communication platforms, or as otherwise decided by Company, for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication.

Changes to this Statement

Company reserves the right to change this Privacy Policy from time to time. Company will notify Customer through official communication platforms, or as otherwise decided by Company, about significant changes in the way Company treats personal information. Customer continued use of Company’s website and/or services available after such modifications will constitute Customer’s: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
